Official Rules for The “Real Ride” 2011 Contest

1. No purchase is necessary to enter or to win.  Purchase or payment of any kind does not increase your chances of winning.
2. Eligibility – The Real Ride Contest is open anyone at least eighteen (18) years old at the time of entry. Void in anyplace where any specifics of this contest are prohibited by law. Employees of RealTruck or any of their respective parents, affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Contest, and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children and their respective spouses, regardless of where they reside) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and RealTruck’s and Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.
3. Contest Period – The Contest begins on May 24th at 12:01 A.M. Central Time (CST) and ends on August 31st at 11:59 P.M. Central Time (CST), 2011.
4. To enter, during the Contest Period, visit the Real Ride Contest Page on Facebook to access the instructions.
5. By submitting photos to RealTruck’s Facebook page, you agree that you are the owner of the photos and the vehicle pictured and you give RealTruck the right and permission to use the photos without restriction for its promotion.  However, you retain copyrights to the photo.
6. The winner will be selected by popular Facebook vote on the last day of each month.  Contest months are June, July and August of 2011.  Previous months winners are not eligible for any other prizes from RealTruck during the 2011 calendar year and are prohibited from re-entering the Real Ride contest again.
7. Once winner is announced, the address of the winner will be confirmed and the prize money sent to the winner. The winner is required to confirm with a Facebook posting once they have received the winnings.
8. Winners are responsible for all taxes and fees associated with prize acceptance and receipt.
9. Entry Conditions and Release – By entering, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the RealTruck which are binding and final in all matters relating to this Promotion; and (b) indemnify, defend, release and hold harmless Facebook, Inc., RealTruck and each of their respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to an entrant’s entry, creation of an entry or submission of an entry, participation in the Promotion, acceptance or use or misuse of a prize and/or the broadcast, exploitation or use of entry. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to RealTruck and not to Facebook.
10. Publicity – Except where prohibited, participation in the Contest constitutes each winner’s consent to RealTruck and its agents’ use of the submitted photos and the winner’s name, likeness, photograph, voice, opinions and/or hometown and state for advertising and promotional purposes in any and all media, now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission.
11. General Conditions – RealTruck reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Promotion, as determined by RealTruck in their sole discretion. If terminated, RealTruck may award the prizes for the drawing(s) at issue at random from among all non-suspect, eligible entries received for such drawing(s) up to time of such action. RealTruck reserves the right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, RealTruck reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. RealTruck’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Limitations of Liability – The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, typographical, printing or other errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) other problems or errors of any kind, whether computer, technical, computer, mechanical, typographical, printing, human or otherwise, which may occur in connection with the Promotion, including, but not limited to, any errors or problems which may occur with the administration of the Contest, the processing of entries, the announcement of the prizes or in any Promotion-related materials; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that if it is not possible to award another entry due to discontinuance of the Contest, or any part of it, for any reason, Contest, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for the prize offered herein. No more than the number of prizes stated herein will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, RealTruck reserves the right to award the prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
13. Disputes – Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prize awarded, other than those concerning the administration of the Contest or the determination of the winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate State Court, for the city of Jamestown, North Dakota; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, and in no event will entrant be able to obtain attorneys’ fees or other legal costs; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdiction do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and RealTruck in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of North Dakota, without giving effect to any choice of law or conflict of law rules (whether of the State of North Dakota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Dakota.
14. Information collected from entrants is subject to the RealTruck’s Privacy Policy.
15. The winner will be announced on the RealTruck Facebook Fan Page.
